Louisiana Adds Conditions to Data Center Tax Break, Rebrands Facilities as 'Digital Factories'

Louisiana Economic Development (LED) on October 29 unveiled the completed framework of the Louisiana Ratepayer and Community Protection Initiative, setting new conditions for companies seeking the state's Data Center Sales and Use Tax Exemption. Baton Rouge, the state capital, is in East Baton Rouge Parish.

Governor Jeff Landry established the initiative by executive order in June to set standards ahead of rapid digital infrastructure growth. The framework requires applicants to demonstrate meaningful commitments across eight areas, including protecting existing ratepayers from project-related cost shifts, strengthening grid reliability, investing in Louisiana's workforce and communities, contributing to local tax bases, protecting natural resources, growing the state's innovation economy, and maintaining transparency and accountability. Commitments may be tailored to each host community's needs.

The exemption becomes an invitation-only program: companies must first file a detailed attestation showing how they will meet the framework before receiving it. Existing statutory thresholds remain — at least 50 new permanent jobs and at least $200 million invested in Louisiana between July 1, 2024 and July 1, 2029. LED will review each submission with the Department of Conservation and Energy, the Department of Environmental Quality, the Public Service Commission and the project's proposed energy provider.

The state will also refer to data centers as "digital factories" going forward, reflecting their role supporting superintelligence computing demand, while the exemption keeps its statutory name.

"Under President Trump's leadership, America is entering a new era of digital infrastructure, and Louisiana is leading the way," Landry said. LED Secretary Susan B. Bourgeois said the framework turns Louisiana's priorities into measurable commitments from the start, giving the state a clear way to evaluate each project's long-term contribution and hold companies accountable.
