Chinese Woman Held by ICE for Nearly Two Months; Federal Court Orders Immediate Release

Sunday, November 1, 2026 · Society · GSM News

On November 1, an immigration detention case followed closely by Southern California's Chinese community took a turn. According to the World Journal's November 1 report, the U.S. District Court for the Central District of California found that the government had failed to provide necessary procedural protections before detaining Chenxing Xu, infringing her due process rights, and on October 30 ordered her immediate release. The court also ordered the government to return all property taken from her at arrest and during detention processing, and to report back to the court on compliance within three days of her release.

According to court documents, Xu entered the United States on April 18, 2024, on a B-2 tourist visa through Los Angeles International Airport, applied for asylum on August 23 of the same year, and her application remains pending. She applied for a work permit in February 2025 and was approved the same month; the documents record no criminal history. On September 4, 2026, as she prepared to board a flight to Seattle at Ontario International Airport, she was detained by Immigration and Customs Enforcement in a targeted immigration enforcement action, and was held at the Adelanto ICE detention center for nearly two months. The ruling does not explain why officers singled her out in the operation. How the release order is carried out remains to be confirmed once the court receives the government's report.
