Federal Judge Rules ICE Repeatedly Violated Warrantless-Arrest Order in Oregon, Finds Fabricated Arrest Report and Expands Disclosure

Monday, November 2, 2026 · Justice · GSM News

U.S. District Judge Mustafa Kasubhai ruled on November 2 that Immigration and Customs Enforcement (ICE) officers repeatedly violated an existing court order restricting warrantless immigration arrests in Oregon, and expanded the order to require the federal government to provide new documentation showing compliance.

In a sharply worded opinion, Kasubhai found that ICE officials in Oregon continued making warrantless arrests without first individually assessing whether a person was likely to escape before a warrant could be obtained. He also found that an ICE deportation officer intentionally fabricated details in an official arrest report to make an arrest appear lawful, writing that the defendants had lost the court's trust through their own conduct.

The new order expands the records ICE must provide to attorneys representing immigrants in Oregon: documents for all civil immigration arrests in the state are now subject to the preliminary injunction regardless of whether ICE characterizes an arrest as warrant-based, and the government must also disclose body-camera footage for arrests made on or after September 1. ICE must retransmit the injunction to relevant officers, employees and contractors every 30 days. Jordan Cunnings, legal director at Innovation Law Lab, said arrest reports alone do not accurately reflect the facts of warrantless arrests.
