Delaware Finalizes Rule Letting Marijuana Growers Produce and Sell Their Own Pre-Rolls From November 11

Monday, November 2, 2026 · States · GSM News

Delaware has finalized a marijuana regulation allowing licensed cultivators to manufacture pre-rolls from their own flower and sell them directly to licensed retailers without obtaining a separate manufacturing license.

The amendments, published in the November 1 Delaware Register of Regulations, revise Rule 5001 of the Office of the Marijuana Commissioner and are scheduled to take effect November 11. Previously, turning flower into pre-roll products required a separate manufacturing license; the new rule expands the activities authorized under a cultivation license itself.

The rule also sets restrictions: cultivators may use only flower grown at their own facility, may not manufacture pre-rolls for another business or sell them under another company's brand, and may not buy flower from other licensees for pre-roll production. Pre-rolls containing concentrates or kief are excluded. Cultivators may not sell directly to consumers; finished pre-rolls must be distributed through licensed retailers, preserving the state's existing retail structure.

The amendment concerns only cultivator-produced pre-rolls and does not change retail licensing, product testing or tax rules.
