Senate Republicans Ask Appeals Court on November 4 to Overturn Ruling on California Vehicle Emissions Waivers

U.S. Senate Majority Leader John Thune and other senior Senate Republicans on November 4 asked a federal appeals court to overturn a ruling that found the Environmental Protection Agency improperly sent California's landmark vehicle emissions rules to Congress for potential repeal, the latest legal clash over California's Clean Air Act waivers.
According to Reuters' November 4 report, the EPA had previously granted California waivers under the Clean Air Act allowing the state to set its own emissions standards for cars, trucks, and lawn and garden equipment. In June, the EPA sent those waivers to Congress seeking their possible repeal, but a federal district judge ruled the move was likely unlawful.
The Senate Republicans are asking the appeals court to reverse the district court's ruling. California's emissions waivers have long been a flashpoint in federal-state environmental policy, and the state's standards carry broad influence over the national auto market. The appeals court has not yet ruled on the request.
