Colorado Amendment 87 Passes, Ending Nearly Four Decades of a Flat Income Tax

Friday, November 6, 2026 · States · GSM News

DENVER, Colo. — The Associated Press confirmed on the morning of November 6 that Colorado's Amendment 87 had passed, and the opposition campaign conceded that morning.

With votes counted as of 10:30 a.m. on November 6 on the secretary of state's website, the measure led 51% to 49%.

The amendment replaces Colorado's flat income tax rate, in place for nearly four decades, with six graduated brackets under which higher earners pay higher rates. The new rates take effect with the 2027 tax year and are expected to raise about $2 billion a year for the state starting in 2028, directed under the amendment to health care, K-12 public education and child care.

Supporters gathered at La Raza Park in Denver on November 5 to declare victory. The Colorado Chamber of Commerce issued a statement on November 6 expressing disappointment, saying small business owners would bear a heavier burden. The amendment required only a simple majority to pass.
