Gallagher Square Noise Lawsuit Goes to Court as Judge Weighs Padres Concerts

SAN DIEGO, Calif. — The Gallagher Square noise lawsuit went before San Diego Superior Court on November 6, with Judge Carolyn Caietti expected to rule the same day.
The suit was brought by the resident group Residents Concerned About Gallagher Square Noise against the city and the San Diego Padres. It has run for three years, and a mediation effort failed in July. The plaintiffs are seeking an injunction ordering the city to enforce its existing noise ordinance and requiring the Padres to lower the volume of the square's outdoor concerts. The city and the Padres argue that Gallagher Square sits within the ballpark district and operates lawfully as a permitted special-events venue.
One focus of the dispute is Item 11, adopted by the City Council in September, which exempts permitted venues from the noise rules; the plaintiffs challenge its legality. The judge may instead issue a tentative ruling rather than a final decision on the day. The outcome will shape the noise dispute between downtown residents and ballpark entertainment.
