Follow-Up: On Day Four of Halle Berry Custody Hearing, Martinez Confronted With 2024 Declaration Denying Any History of Domestic Violence

The custody dispute and domestic violence restraining order hearing between Oscar winner Halle Berry and her ex-husband Olivier Martinez over their 13-year-old son, Maceo, entered its fourth consecutive day on Thursday, October 22, at Los Angeles Superior Court, according to Page Six, as Martinez was confronted during cross-examination with a sworn declaration he signed in 2024.
Berry testified first on Thursday in a closed courtroom before Martinez was questioned by Berry's attorney, Marina Beck. According to Page Six, Martinez confirmed that he was alleging Berry had committed acts of abuse against him dating back 10 years, including statements he claimed Berry made to their son in 2023. Beck then presented him with a declaration he signed under penalty of perjury on September 30, 2024, stating that there had been no history of domestic violence between the two. Martinez confirmed the signature was his and answered Beck's question by saying the statement was true when he made it in 2024.
Martinez's attorney, Patrick Baghdaserians, later told Page Six that the 2024 declaration was related to a need-based attorneys' fees request, not the custody dispute, and that there had been no domestic violence conviction and no restraining order ever requested or entered at the time, so the statement was not false.
The case stems from a court filing Martinez submitted earlier this month. According to court documents reported by Page Six and other outlets, Martinez alleged that Berry put her hands around their son's neck during an altercation at her home on September 26, and said the incident was part of a pattern of behavior that caused the teenager emotional distress; the filing also said Maceo contacted him afterward and asked to be picked up. Earlier this month, a judge granted Martinez a temporary domestic violence restraining order, giving him primary custody of Maceo, restricting Berry's time with their son, and ordering the former couple to stay at least 100 yards apart.
Berry's side denies the allegations. Her attorney Beck previously told Page Six that Martinez's filing was "entirely meritless and deliberately misleading." According to Page Six, Berry's team accused Martinez in pre-hearing filings of interfering with their son's education and therapeutic care and of involving the teenager in their legal disputes. Berry has asked the court to dismiss Martinez's restraining order request, lift the temporary restrictions on her contact with Maceo, grant her sole legal custody, and restore the previous 50-50 physical custody arrangement. Berry's 18-year-old daughter, Nahla Aubry, also submitted a court declaration in her mother's defense, saying she had never witnessed Berry abuse her younger brother.
According to Page Six, Maceo testified for nearly four hours earlier this week in closed proceedings. The former couple are due back in court on Friday, October 23, and the court has not yet made a final ruling on the restraining order or custody.
Berry and Martinez married in July 2013 and welcomed Maceo later that year before separating in October 2015. Their divorce proceedings continued for years until a settlement in August 2023, under which they agreed to share joint legal and physical custody, with Berry paying Martinez $8,000 per month in child support and covering their son's school tuition and other expenses.
