Follow-Up: Justice Department Seeks Preliminary Injunction in Alaska Senate Case, Asking to Block Certification if Incumbent Loses Narrowly

Anchorage, Alaska — The U.S. Justice Department on October 30 asked a federal judge to issue a preliminary injunction that would block Alaska from certifying its Senate election result in specific circumstances, a new development in the civil litigation over the "same-name candidate" controversy.
According to Reuters, the department asked the judge to order that Alaska not certify the result if Republican Senator Dan Sullivan loses narrowly and votes cast for another candidate named Dan J. Sullivan could theoretically change the outcome.
The dispute stems from retired teacher Daniel J. Sullivan, running without party affiliation, sharing the incumbent senator's name. The New York Times reported on October 28 that people connected to Democratic candidate Mary Peltola's campaign appeared to have helped recruit the namesake candidate; Peltola denied knowledge of the effort in Juneau on the evening of October 29.
Alaska Governor Mike Dunleavy has ordered a state investigation, and federal prosecutors confirmed on October 30 that a criminal investigation is under way. The November 3 midterm election will decide control of the Senate, and Alaska is one of the key contested seats.
