Follow-Up: Judge Extends Injunction — CNN, MS NOW and Politico Keep White House Access While Lawsuit Proceeds

Wednesday, October 14, 2026 · Federal · GSM News

WASHINGTON — U.S. District Judge Timothy Kelly of the U.S. District Court for the District of Columbia ruled on October 13 that the Trump administration must continue to allow journalists from CNN, MS NOW and Politico to enter the White House while their lawsuit proceeds, extending the preliminary injunction he had issued earlier in the case.

Kelly found that the ban likely violates the First Amendment to the U.S. Constitution and amounts to viewpoint discrimination. He wrote that President Donald Trump's statements explaining the ban showed the decision was likely causally connected to the three outlets' constitutionally protected speech — in other words, that it was retaliatory.

Kelly also rejected the Justice Department's "national security" justification, writing that there was "no evidence" in the record to support the government's claim.

The case began in late September, when the administration revoked the long-held White House passes of the three outlets' correspondents, citing what it called "negative" coverage. The outlets sued, and Kelly first ordered their access temporarily restored. GSM has covered the dispute from the start: on October 1 we reported Trump's announcement barring the three outlets from the White House (Trump Bans CNN, MS NOW, Politico From the White House), and on October 3 we reported the Justice Department's request to restore the ban (DOJ Asks Court to Allow White House to Reinstate Media Ban on CNN, MS NOW and Politico). "MS NOW" is the new name of the network formerly known as MSNBC.
