Follow-Up: Halle Berry Restraining-Order Hearing Rolls Into a Second Week as Temporary Order Is Extended and Daughter Nahla Is Set to Testify Virtually on Monday

LOS ANGELES — The domestic-violence restraining-order hearing and custody dispute between Halle Berry and her ex-husband Olivier Martinez entered its fifth day on Friday, October 23, at Stanley Mosk Courthouse in Los Angeles, Los Angeles County, California. According to Page Six, Martinez's temporary restraining order against Berry has been extended through the weekend, and the hearing will continue next week.
On Friday, Martinez, 60, continued the closed-door testimony he began on Thursday, doubling down on his claims that Berry abused him. During cross-examination on day four, Berry's attorney Marina Beck confronted him with a sworn declaration he signed in 2024 stating that the former couple had no history of domestic violence. Martinez confirmed the signature was his and answered that the statement was true when he made it on September 30, 2024. His lawyer, Patrick Baghdaserians, told Page Six the declaration concerned a financial request: there had been no domestic-violence conviction and no restraining order had ever been requested or entered at the time, and the statement related to need-based attorneys' fees, not custody.
After the lunch break, Berry's fiancé, singer Van Hunt, 56, took the stand, also behind closed doors. He appeared relieved as he left the courtroom alone around 4 p.m. and was later seen laughing with a member of Berry's legal team. Court adjourned at about 4:30 p.m.; Martinez and his attorneys left first, followed by Berry and her team, and Berry was seen rubbing Hunt's arm in the hallway before leaving the courthouse.
Berry's daughter Nahla Aubry, 18, is expected to testify virtually on Monday when the hearing resumes. Nahla previously submitted a court declaration saying she had never seen her mother abuse her half-brother and was shocked by the claims. Berry herself testified behind closed doors on Thursday about their son Maceo, who spent nearly four hours on the stand in closed proceedings earlier in the week.
The case stems from Martinez's allegation that Berry choked their 13-year-old son Maceo during a confrontation at her home on September 26, which he says was part of an ongoing pattern of abusive behavior, and that Maceo contacted him afterward asking to be picked up. A judge previously granted Martinez a temporary domestic-violence restraining order and primary custody of Maceo, limiting Berry's time with their son while the case proceeds.
Berry has vehemently denied the allegations. Beck previously told Page Six that Martinez's claims were 'entirely meritless and deliberately misleading' and that Berry vigorously denies any wrongdoing. Berry's attorneys have also alleged in court documents that Martinez interfered with Maceo's education and therapy and involved the teenager in their ongoing dispute. Berry has asked the court to dismiss the restraining-order request, lift the temporary restrictions on her contact with Maceo, restore the previous 50-50 physical custody arrangement, and grant her sole legal custody over decisions involving their son's education, therapy and medical care.
Berry and Martinez married in 2013 and welcomed their only child later that year before separating in 2015. Their divorce and custody dispute was settled in 2023 after years of legal proceedings, with Berry ordered to pay Martinez $8,000 a month in child support. The hearing continues next week, and the court has not yet issued a final ruling on the restraining order or custody.
