ICE Agent Shoots Man During Bronx-Area Arrest as His 5-Year-Old Sat in the Back Seat; Mayor and DHS Trade Blame as Protests Reach a Third Day

An Immigration and Customs Enforcement officer shot and wounded Oscar Belgal, 28, a Dominican national, during a targeted arrest on the afternoon of Oct. 8 in New York City's Marble Hill neighborhood, according to USA Today. Belgal was hit in the neck and is expected to survive; his 5-year-old son was in the back seat of the car and was not injured. NYPD Commissioner Jessica Tisch said surveillance video showed Belgal parking his car shortly before the shooting, and the Legal Aid Society, which represents him, said in a release petition that officers fired at least seven rounds.

The Department of Homeland Security said an officer discharged his weapon during a targeted enforcement operation, describing Belgal as unlawfully present with a prior grand-larceny conviction and multiple arrests; federal officials have also alleged ties to the Trinitarios gang, and ICE's enforcement chief said Belgal drove at the officers. The Legal Aid Society disputes the arrest's legality, says lawyers could not locate him for hours after a hospital transfer, and has petitioned for his release. The accounts remain in dispute and the incident is under investigation.

Mayor Zohran Mamdani called the shooting unconscionable, said he phoned President Trump and tried unsuccessfully to negotiate Belgal's release, and demanded ICE leave the city. DHS Secretary Mullin, at an Oct. 9 news conference, blamed sanctuary policies for forcing street arrests, said the agents did not know a child was in the car, and placed responsibility on Belgal. Protests have run for three days — at the scene on Oct. 8, a march of thousands through Lower Manhattan on Oct. 9 with at least five arrests near the hospital, and further demonstrations in Midtown on Saturday, Oct. 10.
