Fresno Homeowner Shot Man Sleeping on His Lawn; Off-Duty ICE Officer Accused of Attacking Homeowner Faces Four Charges

Fresno — On Friday, October 9, at about 3 a.m., a resident in Fresno's Tower District found a man sleeping on his front lawn, according to the Los Angeles Times, the New York Times and the Fresno County District Attorney's Office. When the 72-year-old homeowner asked him to leave, the man, who described himself as intoxicated and agitated, allegedly attacked the homeowner, and allegedly attacked the homeowner's daughter when she intervened.
According to the releases, the man allegedly threw the homeowner into a neighbor's parked vehicle, causing serious damage to the side of the vehicle. The homeowner shot the man once. The daughter's boyfriend, an off-duty police officer, arrived, handcuffed the man and held him until police arrived.
The man is David Gonzalez III, 32, of McAllen, Texas, an off-duty ICE officer who was alone at the time. Police have not said why Gonzalez was in Fresno. The homeowner was not charged.
On October 14, the Fresno County district attorney filed four charges against Gonzalez: felony assault likely to cause great bodily injury, felony elder abuse, felony vandalism and misdemeanor battery. His bail was set at $52,000; if convicted, he faces up to four years and eight months. Gonzalez is currently hospitalized and in custody. The Department of Homeland Security referred questions to Fresno police. Gonzalez has not been convicted.
