FRESNO, Calif. — David Gonzalez III, the off-duty U.S. Immigration and Customs Enforcement (ICE) agent accused of assaulting a Fresno homeowner and his daughter, was arraigned on October 14 in Fresno County Superior Court and pleaded not guilty to all charges. According to FOX26, Gonzalez appeared in court on Wednesday morning; the Fresno Bee reported that he appeared in a wheelchair.

The Fresno County District Attorney's Office filed four counts against Gonzalez on October 14: felony assault likely to produce great bodily injury, felony elder abuse, felony vandalism and misdemeanor battery. FOX26 reported that his bail, originally set at $52,000, was adjusted by the court to $37,000 at the arraignment; reporting by The New York Times also cited the $37,000 figure. FOX26 reported that civil protection orders were served on Gonzalez and that his next hearing is scheduled for October 20.

The case stems from an incident at about 3 a.m. on October 9, when a 72-year-old homeowner in Fresno's Tower District found a man sleeping on his front lawn. Police say the man assaulted the homeowner when asked to leave and also assaulted the homeowner's daughter when she intervened; the man allegedly threw the homeowner against a neighbor's parked vehicle before the homeowner shot him once. Police later identified the man as Gonzalez, 32, of McAllen, Texas, who was alone and off duty. The homeowner was not charged. Gonzalez has not been convicted; if convicted, he faces up to four years and eight months.
