Wednesday, October 21, 2026 · States · GSM News

The West Virginia Tax Division has announced the details of a temporary suspension of enforcement on the highway use of red-dyed diesel fuel, Bloomberg Law reported on October 21. Following the statewide diesel supply emergency declared by Governor Patrick Morrisey on October 20, the division said that under Executive Order No. 2-26 it will not assess civil penalties, issue citations, make arrests, seize fuel or vehicles, or refer persons for prosecution for selling, storing, dispensing or using dyed diesel in highway vehicles, for conduct beginning October 20. The division said additional guidance will follow.

Background: Governor Morrisey declared a 60-day state of emergency covering all 55 counties on October 20, which this site reported previously. The governor's office said the action aims to lower transportation costs, estimating savings of 20.5 cents per gallon, or about $41 on a 200-gallon fill-up for a truck. According to AAA data cited by the governor's office, the average price of diesel fuel in West Virginia reached $6.34 per gallon on October 20, compared with $3.57 at the same time last year. At the federal level, President Donald Trump signed an executive order on October 5 providing temporary federal relief for the highway use of red-dyed diesel.
