Follow-Up: Musk and St. Clair Custody Case Moves Into Settlement Talks as Both Skip Oct. 22 Hearing

NEW YORK — The custody case between Elon Musk and Ashley St. Clair over their 2-year-old son, Romulus, has moved into settlement talks. According to Page Six of the New York Post, neither Musk, 55, nor St. Clair, 28, appeared at an Oct. 22 afternoon hearing in a Manhattan court, while three attorneys for each side negotiated over child support and custody terms.
A source on Musk's side familiar with the case told the Post they were "just being cautiously optimistic" and called the judge "very gracious." The source said St. Clair was seeking an "astronomical" settlement payout and that the lawyers were due back in court next week to try to close out an agreement; other reports put the next hearing on Oct. 29.
St. Clair sued in February 2025 to have Musk legally established as Romulus's father and to win sole custody; court-ordered DNA testing later confirmed Musk is the boy's father. Musk has said he has paid St. Clair $2.5 million. In the documentary "Musk," released earlier this month, St. Clair alleged that Musk cut her monthly child support from $100,000 to $20,000 after she refused to sign a nondisclosure agreement and publicly disclosed the child in 2025, and that she faced eviction even on the reduced payments; she has also claimed Musk offered her $15 million to keep the child a secret. GSM reported the two sides' competing claims over the support cut and the alleged secrecy offer on Oct. 19. Musk announced in January that he would seek full custody of Romulus.
St. Clair's side offered no public comment on the Oct. 22 hearing as of publication; her attorneys took part in the day's settlement talks. Romulus, born in September 2024, is Musk's 13th child; Musk has 14 children in all.
