$711 Million Sits in the NAR Commission Settlement Fund as Payouts Await a Court-Ordered Audit

KANSAS CITY — New court filings have revealed the balance of the National Association of Realtors (NAR) commission lawsuit settlement fund. Documents filed on October 29 in the U.S. District Court for the Western District of Missouri show that as of September 30, 2026, the fund held more than $711 million — precisely $711,251,720.86 — in accounts at Morgan Stanley, having earned about $17.7 million in interest over nine months.
The money comes from the series of settlements NAR and major brokerages reached after a Missouri jury found the industry's commission structure unlawful in 2023. Settlement administrator JND Legal Administration has received and processed more than 2.7 million claims and is currently undergoing a court-ordered audit; its roughly $32.8 million in invoiced administration fees is one focus of that audit.
Yet payouts remain out of reach. Appeals courts this fall rejected objectors' challenges to the settlements' final approval, but objectors can still petition the U.S. Supreme Court. Until the audit and any further appeals are resolved, eligible home sellers do not know how much they will receive, or when.
The litigation has already reshaped how American homes are bought and sold, ending the assumption that sellers pay the buyer's agent commission and making it negotiable. Distributing the fund would be the last piece of that industry earthquake.
