AP Declares All Three Virginia Constitutional Amendments Passed, Including Reproductive Freedom

Tuesday, November 3, 2026 · States · GSM News

On the night of November 3, as counting advanced in Virginia's 2026 midterm elections, the Associated Press declared that all three of the state's constitutional amendments had passed. The first to be called was the amendment establishing a fundamental right to reproductive freedom: with 88.53% of precincts reporting and about 73% of the expected vote counted, 'yes' votes stood at 1,643,326 and 'no' votes at 1,055,943, and the AP called the measure on that basis. The amendment provides that Virginia's constitution will protect an individual's freedom to make and carry out decisions on prenatal care, childbirth, postpartum care, contraception, abortion, miscarriage management and fertility treatment, protects health care providers and patients from punishment for such decisions, and allows restrictions on third-trimester abortion unless the patient's health is at risk or the pregnancy is not viable.

The AP subsequently declared the other two amendments passed as well: the second removes the state constitution's definition of marriage as the union of one man and one woman and bars the state from denying marriage licenses to two adults based on sex, gender identity or race; the third automatically restores voting rights to people convicted of felonies after they complete their sentences and establishes voting as a fundamental right. The same day, Virginia voters also chose a U.S. senator and all 11 U.S. House members; the AP confirmed Democratic Senator Mark Warner's reelection shortly after polls closed. All results are unofficial until certified.
