Ohio Prosecutors Say Hinton's New-Trial Motion in Hamilton County Has No Legal Basis, in November 4 Filing

Wednesday, November 4, 2026 · States · GSM News

On November 4, Hamilton County prosecutors filed a written response in the Court of Common Pleas arguing that Rodney Hinton Jr.'s motion for a new trial has no legal basis and cannot be considered by the court. The Cincinnati Enquirer reported that prosecutors said the motion rests on what one juror allegedly said in the presence of Hinton's attorneys after the trial ended, and that Ohio law prohibits a court from receiving or considering juror statements or testimony about the deliberation process. They asked the court to deny the motion without a hearing.

Hinton's attorneys, Clyde Bennett II and James Bogen, have argued that alleged juror misconduct violated Hinton's constitutional right against self-incrimination and his right to a fair trial, and asked the judge to schedule a hearing. Hinton was convicted of murder, two counts of reckless homicide and two counts of felonious assault for the May 2025 killing of Hamilton County Sheriff's Deputy Larry Henderson, and faces 15 years to life in prison. The jury acquitted him of the two most serious charges, aggravated murder counts punishable by life without parole. Prosecutors maintain the material behind the motion cannot legally support a new trial and that the case should proceed to sentencing.
