Wednesday, November 4, 2026 · States · GSM News

A retired Oklahoma judge has been arrested for allegedly firing a gun toward trick-or-treaters on Halloween night, in a case reported by legal media on November 4. The ABA Journal reported on November 4 that former Judge Jerry Herberger, 73, of Duncan, was booked into the Stephens County Jail on charges including assault and battery with a deadly weapon, attempted murder and possessing a firearm while intoxicated. According to the Lawton Constitution, police were called on the night of October 31 after witnesses said an intoxicated Herberger had threatened to shoot trick-or-treaters who came near his home and fired a round in the children's direction; as officers prepared to make contact, he allegedly pointed a gun at one officer before complying with commands, exiting the home and being taken into custody.

The reports do not say whether anyone was struck or injured. Herberger is a former judge; the case is being handled by local law enforcement and prosecutors, and the charges are allegations that must be decided in court. Local police have not released further details, and more is expected from prosecutors as the case proceeds.
