New York Man Faces Five Leandra's Law Felonies After DWI Stop With Five Children: Youngest Passenger Two Months Old, BAC 0.15 Percent

The New York State Police reported on November 3 that troopers from the New Rochelle station stopped a 2012 Mazda sedan at about 1:28 a.m. on October 31 on South Main Street in the Village of Port Chester, Westchester County, after observing children riding without proper restraints in the back seat. The driver was Fredy Arnoldo Regalado Carranza, 32, of Port Chester.
Troopers observed signs of intoxication during their interview, and field sobriety tests indicated impairment. Five children were inside the vehicle, ranging in age from 15 years to just two months old. Regalado Carranza was taken to the New Rochelle State Police station, where testing determined his blood alcohol concentration was 0.15 percent, nearly twice New York's legal threshold of 0.08 percent.
He faces five counts of aggravated driving while intoxicated with a passenger younger than 16, Class E felonies under Leandra's Law, as well as two misdemeanor charges of operating a motor vehicle with a blood alcohol concentration of 0.08 percent or greater and driving while intoxicated, plus multiple vehicle and traffic law violations. The five felony counts correspond to the five children found in the vehicle.
Following his arrest, Regalado Carranza was released to a sober third party, and the five children were also turned over to a sober third party; authorities did not identify the children's relationship to him. He is scheduled to appear in Rye Town Court on November 20, 2026.
