DHS DeepSeek Exclusion Order Published in Federal Register: Agencies Must Stop Buying and Remove the Products

The Department of Homeland Security's Exclusion and Removal Order #2026-01 targeting Chinese super intelligence company DeepSeek was formally published in the Federal Register on October 20 (91 FR 66346, FR Doc. 2026-21447, Docket No. DHS-2026-0628). The order was signed by Secretary of Homeland Security Markwayne Mullin on July 24, 2026, made available for public inspection on October 19, and published on October 20.
Issued under the Federal Acquisition Supply Chain Security Act of 2018 (FASCSA) and following the recommendation of the Federal Acquisition Security Council, the order covers products of Hangzhou DeepSeek Super Intelligence Co. and its affiliates, as well as third-party products and services developed or enabled using DeepSeek technology. Federal civilian agencies must immediately stop procuring covered products and remove them from their information technology systems. Department of Defense and intelligence-community procurement is outside the order's scope and handled separately.
The order cites multiple threat vectors in DeepSeek models, including potential transmission of sensitive data to China, the risk that such data could be assembled into actionable intelligence against U.S. persons and institutions, and the possibility that the models themselves contain malware or vulnerabilities; it also references February 2025 research by NowSecure reporting serious security flaws in the company's iOS app. Agencies and vendors may direct questions to CISA's FASCSA team.
