Follow-Up: DHS Secretary Markwayne Mullin Says Multiple Warrants Were Served in Omar Probe, Case Expected to Go Before Grand Jury

WASHINGTON — Homeland Security Secretary Markwayne Mullin spoke publicly on October 16 about the federal investigation of Rep. Ilhan Omar of Minnesota, telling the podcast The Charlie Kirk Show that the October 12 search of Omar's Washington residence was not the only warrant executed that day, according to CBS News. Investigators served multiple additional warrants the same day, all signed by a judge, and expect to take the case to a grand jury, he said.

GSM previously reported that Homeland Security Investigations (HSI) agents searched Omar's Washington home on October 12 under a judicially authorized warrant confirmed by the Justice Department, and that investigators had subpoenaed her sister and other relatives. According to CBS News, several of Omar's relatives received grand jury subpoenas the preceding Friday, and her personal cellphone was seized during the October 12 search. The investigation, led by HSI with assistance from the Justice Department, is examining possible false statements and fraud in her family's immigration paperwork, including documents submitted by her late father when she was a child.

"It wasn't the only place we served the warrant," Mullin said. "There was multiple other warrants served on that same day. We had a judge sign it, and we expect to be able to take the case to a grand jury." Defending the probe against claims of political motivation, he added: "We wouldn't move forward — and President Trump didn't want to move forward either — unless we knew that it couldn't be politically driven. This was about enforcing, once again, our nation's laws. And it's a strong case." Mullin also raised the possibility that coordinated immigration fraud could be examined under the federal Racketeer Influenced and Corrupt Organizations Act (RICO); he did not say prosecutors had decided to bring such charges.

Omar has not been charged with any crime. She denies any wrongdoing in immigration matters and has called the investigation politically motivated. Grand jury subpoenas and search warrants are investigative steps and do not by themselves establish that a subject committed an offense.
