Follow-up: Indiana Death Row Inmate's Lawyers File Supplemental Briefing Seeking to Pause November 5 Execution Pending Drug Quality Proof

Lawyers for Indiana death row inmate Jeffrey Weisheit submitted supplemental briefing to Governor Mike Braun on November 3 asking that the execution scheduled before sunrise on November 5 at the Indiana State Prison in Michigan City be paused until the state produces evidence that its execution drugs are potent, pure and properly stored. The filing came a day after Braun denied Weisheit's request to commute his sentence to life without parole, while a separate request for a temporary reprieve and independent review of the execution protocol remains pending. Weisheit was sentenced to death for the 2010 arson deaths of 8-year-old Alyssa Lynch and 5-year-old Caleb Lynch near Evansville.
The briefing focuses on the state's newest $275,000 supply of pentobarbital: the Department of Correction confirmed on November 2 that it holds the drugs, and inventory records given to the media show six 50-milliliter vials received on October 29, but no test results, expiration dates or temperature readings. The lawyers say Indiana has provided no documents proving the new drugs' potency, purity or stability and no storage-temperature records for them, while earlier public-records temperature logs showed readings outside the recommended storage range. The filing also questions the Indianapolis pharmacy identified as the execution-drug supplier, which is currently on probation and faces a November 9 hearing over alleged compounding-limit violations.
